This Privacy Policy outlines how JG Wentworth Company, LLC and our family of companies (collectively “JG Wentworth,” “we,” “us” or “our”) use, share and disclose information that relates to you (“personal information”). This Privacy Policy applies to personal information that is collected and processed by us in the course of our business, including on www.jgwentworth.com (the “Site”), and via our other online or offline offerings (together with any and all future offerings operated by or on behalf of JG Wentworth, the “Services”). This Privacy Policy applies to all users of the Services.

PLEASE REVIEW THIS PRIVACY POLICY CAREFULLY. When you submit information to or through the Site and/or Services, you consent to the collection and processing of your information as described in this Privacy Policy. By using the Site and Services, as applicable, you accept the terms of this Privacy Policy, our  Terms of Use, and confirm that you are not located outside the United States, and consent to our collection, use, disclosure and retention of your information as described in this Privacy Policy.

If you are an individual who utilizes our Services to obtain a financial product or service through us, we will use and share any information that we collect from or about you in accordance with our U.S. Consumer GLBA Privacy Notice. Information subject to our Privacy Notice is referred to as Non-Public Personal Information (“NPPI”).

2. Personal Information We Collect

JG Wentworth collects personally information from you, which may include information you provide voluntarily to us, information we collect automatically, and information that may be provided from third-party sources. The personal information we may collect includes:

 

  • Identifiers, including name, alias, postal address, unique personal identifier, email address, work email address, account name, social security number, driver’s license number, passport number, or other similar identifiers.

  • Device Information, such as information pertaining to the device through which you interact with our Services, such as your IP address, the type of device used to interact with the Services, that device’s operating system and version, MAC address, user settings, carrier information, or your browser type

  • Personal Information Categories Listed in the California Customer Records Statute (Cal. Civ. Code § 1798.80(e)), such as your signature, physical characteristics or description, address, telephone number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information. Some personal information included in this category may overlap with other categories.

  • Internet/Electronic Network Activity Information, such as your browsing history, search history, and information regarding your interactions with our Site, Services, or advertisements.

  • Financial Qualification Information, including financial qualification information for debt services that includes estimates of personal consumer debt. This may include information about employment status, your approximate credit rating, highest level of education, marriage status, or other similar information. 

  • Healthcare Information, including information you disclose about your current health and medical history (e.g., via medical questionnaires).  

  • Commercial Information, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

  • Other Content, including content within any messages you send to us (such as feedback and questions to customer support).

  • Sensitive Personal Information, such as your Social Security number, certain health-related information, driver’s license number, or passport number. 

3. Sources of Personal Information

We obtain the categories of personal information listed above from the following categories of sources:

  • Directly from you (e.g., when you communicate with us directly or fill out a form on our Site).
  • Information we collect automatically, including through your use of our Site and Services (please see the “Information We Collect Automatically” for additional information about this type of collection activity).
  • Data brokers, from which we purchase data to supplement the data we collect.
  • Social networks, when you engage with our content, reference our Service, or grant us permission to access information from the social networks.
  • Publicly-available sources, including court records and other documents in data in the public domain. 
  • Credit Bureaus, in instances when you submit an application and a credit report is furnished.

4. Information We Collect Automatically 

When you visit or browse our website, we and our advertising, marketing, or service partners may collect information such as your IP address, the URL of the web pages you visit, and may use tracking technologies to collect statistical and other information about your use of our website and other websites (collectively, “Tracking Technologies”). 

These Tracking Technologies including the following:

  • Log Files, which are files that record events that occur in connection with your use of the Site. 
  • Cookies, which are small data files stored on your device that act as a unique tag to identify your browser. We use two types of cookies: session cookies and persistent cookies. Session cookies make it easier for you to navigate our website and expire when you close your browser. Persistent cookies help with personalizing your experience, remembering your preferences, and supporting security features. We may incorporate pixels from separate entities that allow us to track our communications, bring you advertising both on and off the Site.

6. How We Disclose Your Personal Information

We disclose your personal information to third parties for a variety of purposes, including to provide our Services or operate our business, to protect us or others, or in the event of a major business transaction such as a merger, sale, or asset transfer, as described below. We do not sell your personal communication consent or communication opt-in data for marketing purposes.

Disclosures to Provide Our Services

The categories of third parties with whom we may share your personal information are described below. 

  • Service Providers. We may share your personal information with our third-party service providers and vendors that assist us with the provision of our Services. This includes service providers and vendors that provide us with IT support, hosting, payment processing, customer service, and related services.
  • Business Partners. We may share your personal information with business partners to provide you with a product or service you have requested. We may also share your personal information with business partners with whom we jointly offer products or services. Please note that this includes, but is not limited to, our lending partners. 
  • Affiliates. We may share your personal information with our company affiliates for example: for our administrative purposes, IT management, or for them to provide services to you or support and supplement the Services we provide. 
  • Advertising and Analytics Partners. We may share your personal information with third-party advertising and analytics partners. These third-party advertising partners may set Tracking Technologies and other tracking tools on our Services to collect information regarding your activities and your device (e.g., your IP address, cookie identifiers, page(s) visited, location, time of day). These partners may use this information (and similar information collected from other services) for purposes of delivering personalized advertisements to you when you visit digital properties within their networks. Your interactions with these platforms are governed by the privacy policy of the company providing it.

We may access, preserve, and disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our, or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.

Disclosure in the Event of Merger, Sale, or Other Asset Transfers

If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction, as permitted by law and/or contract.

  • Email Communications. If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. Note that you will continue to receive transaction-related emails regarding products or Services you have requested. We may also send you certain non-promotional communications regarding us and our Services, and you will not be able to opt out of those communications (e.g., communications regarding our Services or updates to our Terms or this Privacy Policy). 
  • Phone calls. If you receive an unwanted phone call from us, you may opt out of receiving future phone calls from us by following the instructions which may be available on the call or by otherwise contacting us as set forth in “Contact Us” below.
  • Cookies and Personalized Advertising. When you visit our Site, information collected, such as from cookies stored on your browser, may be sold or shared to third parties. To opt out of the sale or sharing of personal information, please communicate your choice using the button below. Please note you must separately opt out in each browser and on each device.

Please note that cookie-based opt-outs are not effective on mobile applications. Shine the Light: California’s “shine the light” law (Civil Code Section § 1798.83) permits users of our Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Data Retention: JG Wentworth retains the personal information we receive as described in this Privacy Notice for as long as necessary to fulfill the purpose(s) for which it was collected, carry out our operations, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, comply with applicable laws, or based upon other criteria, including, but not limited to, the sensitivity and volume of such data.  Additionally, we endeavor to retain all such personal information in accordance with legal requirements.  Any biometric identifiers or biometric information that we collect will be deleted when it is no longer needed for the purpose it was collected or 3 years after our last interaction with a Participant, whichever occurs first.

How to Exercise Your Rights, Verification Procedures, and Authorized Agents

  • How to Submit a Request to Opt Out of the “Selling” or “Sharing.” Our use of Tracking Technologies may be considered a “sale”/ “sharing” under California law. You can opt-out of being tracked by these technologies by clicking the “Your Privacy Choice” link at the bottom of our website and selecting your preferences, or by contacting us at 1-800-715-8127 or emailing us at [email protected]. Please note that even after opting out, your use of our websites may still be tracked by us or our Service Providers. 
  • Authorized Agent. You may designate an authorized agent to make a request on your behalf. If you submit a request on behalf of another person as an authorized agent, we may require additional proof that you are authorized and information to verify the identity of the person for whom you are submitting a request.
  • Verification. Once you submit a request, we will verify that you are the consumer to which the request pertains by matching your contact information with information we maintain. Depending on the type of request you submit, we will attempt to match either two or three of these data points you provided. If we are unable to verify your request with the data points you provided, we may reach out to you for additional information to verify your request. In some instances, we may not be able to honor your request. For example, we will not honor your request if we cannot verify your identity or if we cannot verify that you have the authority to make a request on behalf of another individual. Additionally, we will not honor your request where an exception applies, or where the personal information that we maintain about you is not subject to the CCPA’s access or deletion rights.

The CCPA includes exemptions under which the aforementioned rights may not extend to personal information protected by other laws, including the Gramm-Leach-Bliley Act (GLBA), the Health Insurance Portability and Accountability Act (HIPAA), the Fair Credit Reporting Act (FCRA), and/or the Driver’s Privacy Protection Act.

We employ a number of organizational, technical and physical safeguards designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies, and we cannot guarantee the security of your personal information.  To the fullest extent permitted by applicable law, we do not accept liability for unauthorized access, use, disclosure, or loss of personal information.

By using our Services or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Services.

What are your mobile terms?

When you provide us with your mobile phone number, and opt-in to the J.G. Wentworth program you agree that J.G. Wentworth may send you text messages (including SMS and MMS) to that phone number. J.G. Wentworth one-time messaging. You will receive a confirmation text message, and you may need to reply as instructed to complete registration. Message and data rates apply. Reply STOP to cancel, HELP for help. You agree to receive a final text message confirming your opt-out. You may opt-out at any time by texting the word STOP to shortcode 87700. For help, send a text message with the keyword HELP to shortcode 87700. Texts may be sent through an automatic telephone dialing system. Consent is not required to purchase our goods or services. What can I expect to receive?

When you provide us with your mobile phone number and opt-in to the J.G. Wentworth, you agree that J.G. Wentworth may send you communication via text message (including SMS and MMS) to that mobile phone number.

How do I sign up for these text messages?

For our J.G. Wentworth Text Alerts: All you have to do is text “CASHNOW” to 87700. One-time messaging, message and data rates may apply, and you can always text HELP for help & STOP to cancel. When you opt-in to the service, we will send you an SMS message to confirm your signup.

If at any time you forget what keywords are supported, just text HELP to 87700. After you send the SMS message HELP to us, we will respond with instructions on how to use our service as well as how to unsubscribe.

How do I opt out of these text messages?

You can cancel the SMS service at any time. Just text STOP to 87700. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Will I be charged for the text messages I receive?
